Terms and Definitions

Acceptance — acceptance of the terms of this Offer by the Buyer.

Order — payment for the goods placed in the shopping cart.

Pre-order — the consumer’s expression of intent to acquire in the near future any goods currently in production or preparation for sale.

Online Store — the Seller of the Goods, carrying out the sale and delivery.

Cart — the Website page where the Goods that the Buyer intends to purchase are added.

Buyer — an individual who has performed the Acceptance and places an order for Goods via the webpage www.danilyad.com.

Seller — the owner of the Online Store responsible for its operation and compliance with the terms of the Offer.

Website — the internet resource located at www.danilyad.com where Goods can be ordered.

Goods — products available for order on the Website.

3D Model — a virtual file in STL format.

General Provisions

This agreement (hereinafter referred to as the “Offer”) is a public offer and governs the procedure of interaction between Individual Entrepreneur Danil Viktorovich Yarmin (hereinafter referred to as the “Seller”) and individuals purchasing Goods (hereinafter referred to as the “Buyer”) in the online store located at www.danilyad.com (hereinafter referred to as the “Website”).
The Buyer is an individual acquiring Goods for personal, family, or other household needs.
The current version of the Offer is published on the Website at www.danilyad.com/offer.

Subject of the Offer

The Seller undertakes to transfer ownership of the Goods to the Buyer, and the Buyer undertakes to accept and pay for the Goods.
Familiarization with the characteristics of the Goods, order terms, selection, and placement of the Order are carried out by the Buyer on the Website.
Acceptance of the Offer constitutes payment for the Order on the Website. The Acceptance of the Offer is full and unconditional.

Price of Goods and Settlement Procedure

Unless another period is specified, the price and other characteristics of the Goods indicated on the Website are valid at the moment of Order payment.
Payment for the Goods and delivery is made on a 100% pre-payment basis prior to the shipment of the Order to the Buyer.

Pre-order Terms

When placing a pre-order, the buyer provides information regarding their name, contact methods, location, delivery method, and payment method.
The Seller specifies the estimated timeframe upon clarifying the order in a reply email. This timeframe may be modified, but by no more than 1 month. If the timeframe changes, the buyer is notified via the email address or phone number provided during the pre-order.
If, due to circumstances beyond the seller’s control, the release of the goods for sale is canceled or postponed indefinitely by the manufacturer, the seller reserves the right to unilaterally cancel pre-orders.

Interaction Procedure of the Parties

Within 2 (two) calendar days from the moment of placing the Order on the Website, the Seller contacts the Buyer to confirm, determine the prepayment method, and agree on the place, date, and time of Goods delivery. The Seller provides the Buyer with Order confirmation via the specified email address.
The Seller’s obligation to transfer the Goods arises only after the Buyer makes the payment.
Failure to make payment within 5 (five) calendar days after placing the order on the Website is deemed a rejection of this Offer.
The Buyer must be present at the delivery location at the agreed date and time or ensure the presence of their representative.
If delivery is made within the agreed timeframe but the Buyer is unable to accept the Goods, the Parties must agree on a new delivery date, and the Buyer shall pay for the re-delivery.
The Buyer inspects the appearance, quality, and completeness of the Goods at the time of acceptance.
The risk of accidental loss or accidental damage to the Goods passes to the Buyer upon receipt of the Goods.
If the Buyer refuses to sign the document confirming the transfer of the Goods, the Seller/authorized representative makes a note in such document and is entitled to record the fact of delivery and transfer using photo and video recording, to which the Buyer consents by performing the Acceptance.
If the Seller fails to fulfill the obligation to transfer the Goods within the stipulated timeframe, the Buyer may, at their discretion, demand:

Delivery of the Goods within a new timeframe;

Refund of the prepayment.

If the Buyer discovers defects in the Goods that were not specified by the Seller, the Buyer has the right to demand:

Replacement with another Item of the same article/sku;

Replacement with a similar Item of a different model (article/sku) with a price recalculation;

A proportional reduction in price;

Immediate free elimination of product defects or reimbursement of expenses for their correction by the Buyer or a third party;

Refund of payment and cancellation of the Agreement.

The Buyer has the right to refuse the Goods at any time prior to delivery, and after delivery — within 7 (seven) calendar days. In this case, the amount spent by the Seller on delivery from the Buyer is non-refundable.
Within 14 (fourteen) calendar days from the receipt of the Goods, the Buyer may exchange it for a similar item of the same or different model if the item does not fit in shape, dimensions, color, size, or configuration.
Claims, requirements, and requests for return/exchange of Goods must be sent to the Seller’s email address.
The Buyer’s request to exchange Goods of proper quality shall be satisfied if the Goods have not been used, their presentation and consumer properties are preserved, and a sales receipt, cash receipt, or other payment confirmation document is provided.

Order and Terms of Use of the 3D Model

Within 2 (two) calendar days from placing the Order on the Website, the Seller sends the Buyer an archive containing the STL file for 3D printing. The Buyer undertakes to save the file locally — re-sending is available upon request only. The download link is valid for 30 days from the moment the archive is sent. The Seller’s obligation to transfer the 3D Model arises only after the Buyer makes the payment.
The Buyer undertakes not to violate the End-User License Agreement.

The Buyer has the right to:

Print and use 3D prints of the 3D model for personal use;

Share images of 3D prints of the 3D model in communication channels such as social media or websites.

The Buyer is strictly prohibited from:

Commercial use or public sharing of the 3D model file;

Modifying or adapting the 3D model for public sharing or sale;

Distributing, selling, gifting, or exchanging digital files of the 3D model.

All rights to the 3D Model remain with the Seller.

Refunds for digital goods are not issued after access to download has been granted, except for cases where:

The file proves to be damaged, inoperable, or does not match the description (e.g., fails to open, contains geometry errors);

A file different from the one specified in the description was provided.

In such cases, the Buyer must submit a support request with supporting evidence (screenshots, error logs).
Decisions on refunds are made within 5 business days.

Quality and Warranty Period

The Seller guarantees that the Goods at the time of delivery are new (unused, refurbished unless stated otherwise), un-sold, un-pledged, free from disputes, arrests, and any third-party rights and/or claims.
The Buyer acknowledges that the color of the Goods may differ from the photos on the Website due to the color rendering characteristics of the Buyer’s device and differences in manufacturer dyes. Such differences are not considered a breach of quality terms.
The Buyer may not claim inadequate quality of the Goods if they match the characteristics specified on the Website but fail to satisfy the Buyer’s subjective expectations.
The warranty period for the Goods and their components is 6 (six) months.
The Seller guarantees the overall quality of the Goods, their parts, and components.

Limitation of Liability

For breach of obligations under this Offer, the Seller bears liability in accordance with applicable consumer protection laws.
The Seller is not liable for damage caused to the Buyer as a result of improper use of the Goods.
Otherwise, the Parties bear liability in accordance with current legislation.

Validity and Termination of the Offer

This Offer enters into force upon Acceptance and remains valid until the Parties fully fulfill their obligations.
The Seller reserves the right to unilaterally amend this Offer. The new version of the Offer applies from the moment of publication and does not apply to Orders placed under the previous version. Buyers and visitors must independently monitor updates to the Offer.

Force Majeure

The Parties are released from liability for partial or full non-fulfillment of obligations under the Offer if caused by extraordinary circumstances beyond the control of the Parties that could not have been foreseen or prevented.
If force majeure circumstances continue for more than 2 (two) months, the Parties shall negotiate to determine alternative acceptable ways of performing the Offer.

Miscellaneous

Disputes under the Offer shall be resolved through negotiations or in court.
